Judge Denies Request for Eminent Domain

Exactly one year ago today, the U.S. Supreme Court ruled in Kelo vs. New London that a home can be taken by the government and sold to a seperate entity for private use. The only requirement is for the city government to have a better plan in place by way of job creation and greater taxable revenue. Earlier this year the state legislature stepped up and changed Florida law so private property can only be purchased for public uses. Yesterday, Broward Circuit Court Judge, Ronald Rothschild put the brakes on a project which sought to do exactly what the legislature ruled against just months ago.

Today's Sun-Sentinel tells the story of a Broward family who owns a 2900 square ft building, which they refuse to sell to a developer who wants to build a 19 story condo and retail tower. The Mach family said, "This just shows a lot of people unified can stand up to a bully." As a side note, IMBD tells us that this is the same Judge who gave actor Brad Renfro 90 days in rehab for an act of public intoxication.
